PLEASE READ THESE TERMS CAREFULLY. THEY INCLUDE AN ARBITRATION AGREEMENT AND CLASS ACTION WAIVER (SECTION 25) THAT AFFECT YOUR LEGAL RIGHTS. BY USING THIS SITE OR PURCHASING OUR PRODUCTS, YOU AGREE TO BE BOUND BY THESE TERMS.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of www.plastno.com (the "Site") and your purchase of Plastno products. The Site is owned and operated by Plastno Inc. ("Plastno," "we," "us," or "our"), a Delaware corporation.

By using the Site, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, our Returns and Refunds Policy, and our Subscription Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Site.

2. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on the Site with an updated "Last updated" date, and where appropriate, we will notify users via email or a Site banner. Your continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site or purchase products. By using the Site, you represent and warrant that you meet this requirement and have the legal authority to enter into these Terms.

4. Your Account

To place an order or manage a subscription, you may be required to create an account. You agree to:

Provide true, accurate, current, and complete information
Keep your login credentials confidential
Notify us immediately of any unauthorized access or suspected compromise
Accept responsibility for all activity that occurs under your account

We reserve the right to suspend or terminate your account if we believe you have violated these Terms, provided inaccurate information, or engaged in fraudulent or abusive behavior.

5. Privacy

Your use of the Site is also governed by our Privacy Policy. By using the Site, you consent to our collection, use, and disclosure of your personal information as described in the Privacy Policy.

6. Products, Availability, and Ordering

Product availability is not guaranteed. If a product is out of stock or no longer available after you place an order, we will notify you by email and issue a refund for the affected item. We reserve the right to accept, decline, limit, or cancel any order at our discretion, for any reason, including suspected fraud, pricing errors, product unavailability, or violations of these Terms.

Your order confirmation email is an acknowledgment of receipt, not acceptance. Acceptance occurs when the product ships. Your payment method will be charged at the time of shipment, unless otherwise noted (for example, subscription orders are charged at the start of each billing cycle).

7. Pricing, Taxes, and Payment

All prices are listed in US dollars unless otherwise indicated. Prices are subject to change without notice. You agree to pay the price shown at checkout, plus applicable taxes and shipping. Taxes are calculated based on your shipping destination.

We do not honor pricing errors. If a product is listed at an incorrect price due to a typographical, technical, or system error, we reserve the right to cancel the order and issue a full refund, whether or not the order has already been confirmed or charged.

8. Shipping

Orders are fulfilled and shipped by Plastno's third-party carriers. Shipping times are estimates, not guarantees. Risk of loss and title transfer to you upon delivery to the carrier. For issues with lost, damaged, or undelivered packages, please see our Returns and Refunds Policy.

9. Returns, Refunds, and Exchanges

Returns, refunds, damaged/defective items, wrong items, and lost packages are governed by our Returns and Refunds Policy. Please review it carefully.

10. Subscriptions

Subscription purchases are governed by our Subscription Cancellation Policy, which explains billing, renewals, cancellation, skipping, failed payments, and price changes. By starting a subscription, you authorize Plastno to automatically charge your payment method on the schedule you select until you cancel.

11. Gift Cards

Plastno gift cards:

Are issued in US dollars
Have no expiration date
Are non-refundable and non-returnable
Cannot be redeemed for cash (except where required by law)
Cannot be replaced if lost or stolen
May not be used to purchase additional gift cards
Are void if obtained fraudulently or through unauthorized means

Gift cards may be applied to product purchases, subscriptions, taxes, and shipping. Any unused balance remains on the card after partial redemption.

12. Promotional Codes and Discounts

Promotional codes, discount codes, and special offers:

Are limited to one per order unless explicitly stated otherwise
Cannot be combined with other offers unless explicitly stated
Cannot be applied retroactively to prior orders
May have expiration dates, minimum purchase requirements, or product restrictions
Are non-transferable and hold no cash value
May be modified, limited, or canceled by Plastno at any time
Are void if obtained through fraudulent or unauthorized means
Do not apply to gift cards, taxes, or shipping unless specified

If an order is canceled or returned, the promotional code used may not be reissued. We reserve the right to refuse or cancel orders that appear to exploit promotional offers in bad faith, including but not limited to multiple account creation, code scraping, or resale activity.

13. Reviews, Testimonials, and Ratings

We welcome honest feedback. By submitting a review, rating, or testimonial, you agree that:

Your review reflects your honest and genuine experience with the product
You are the sole author of the review
Your review does not violate any third-party rights or applicable law
We may publish, edit for length or clarity, remove, or decline to publish any review at our discretion
You grant us a perpetual, royalty-free, worldwide license to use your review in marketing, advertising, and promotional materials (see Section 14)

Incentivized reviews. Plastno may offer discounts, promotional codes, or other benefits in exchange for customer reviews (for example, 10% off for leaving a review). If you received any form of compensation or incentive, you must disclose it in your review in accordance with Federal Trade Commission (FTC) guidelines. Plastno does not pay for positive reviews, and incentives are offered regardless of whether the review is positive or negative.

14. User-Generated Content

When you post content on or about Plastno, including reviews, photos, videos, comments, and social media posts that tag Plastno or use Plastno-related hashtags (collectively, "User Content"), you grant Plastno a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display the User Content in connection with Plastno's business, including marketing, advertising, social media, email campaigns, and the Site. This license includes the right to use your name, handle, and likeness as they appear in the User Content.

You represent and warrant that:

You own or have the necessary rights to the User Content you submit
The User Content does not infringe on any third party's intellectual property, privacy, publicity, or other rights
The User Content is not defamatory, obscene, harassing, misleading, or unlawful
Any people depicted in the User Content have consented to its use as described above

We reserve the right, but are not obligated, to monitor, edit, or remove User Content. If you no longer want Plastno to use specific User Content you've submitted, email hello@plastno.com and we will take reasonable steps to remove it from future use, though we may not be able to recall content that has already been published or distributed.

15. Product Safety and Disclaimers

Plastno products are designed to be safe and effective for household cleaning. However, as with any cleaning product:

Keep out of reach of children and pets. While our products are formulated to be safer than conventional cleaners, they are not intended for consumption and should be stored safely.
Individual sensitivities vary. If you have sensitive skin or known allergies, we recommend performing a patch test before regular use. Discontinue use if irritation occurs.
In case of accidental eye contact, rinse thoroughly with water. Seek medical attention if irritation persists.
In case of accidental ingestion, do not induce vomiting. Drink water and contact Poison Control (1-800-222-1222 in the US) or your local emergency service immediately.
Surface compatibility. Test on an inconspicuous area before use on delicate, antique, or finished surfaces. Plastno is not responsible for damage resulting from misuse or use on incompatible materials.
Follow label instructions. Use our products as directed on the label and packaging.

Plastno makes product claims (including "plant-based," "plastic-free," "compostable," and "safe for kids, pets, and sensitive skin") in good faith and based on available testing and certifications. These claims describe product formulation and typical performance. Individual results may vary.

16. Intellectual Property

All content on the Site, including text, graphics, logos, images, photographs, video, audio, software, product designs, and layout (collectively, "Content"), is owned by or licensed to Plastno and is protected by copyright, trademark, and other intellectual property laws.

Trademarks. "PLASTNO" and related logos and branding are trademarks of Plastno Inc. Trademark applications are currently pending in the United States and Canada. Unauthorized use is prohibited.

You may not copy, reproduce, modify, distribute, publish, transmit, display, or create derivative works from any Content without our prior written permission, except as expressly permitted by Section 17.

17. Limited License to Use the Site

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to access and use the Site and Content for your own personal, non-commercial use. This license does not permit:

Resale or commercial use of the Site or Content
Collection or use of product listings, descriptions, images, or prices for commercial purposes
Derivative works based on the Site or Content
Use of data mining, scraping, robots, or similar tools
Framing, mirroring, or reverse engineering any part of the Site
Any use that violates applicable law or these Terms

This license terminates automatically if you violate these Terms.

18. Prohibited Uses

You agree not to:

Use the Site for any unlawful purpose or in violation of these Terms
Interfere with or disrupt the Site, servers, or networks
Attempt to gain unauthorized access to any account, system, or data
Upload viruses, malware, or other malicious code
Impersonate any person or entity
Harvest or collect information about other users
Use the Site to harass, abuse, or harm others
Engage in fraudulent activity, including payment fraud, promotional code abuse, and chargeback fraud

19. Third-Party Links and Content

The Site may link to or display content from third parties. Plastno does not endorse, control, or take responsibility for third-party websites, products, or content. Your interactions with third parties are governed by their own terms and policies.

20. Accessibility

Plastno is committed to making the Site accessible to people with disabilities. We work within the capabilities of our e-commerce platform (Shopify) and theme to support accessibility standards aligned with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA where reasonably possible.

If you encounter an accessibility barrier on the Site, please email hello@plastno.com with the subject line "Accessibility" and a description of the issue. We will review and address accessibility concerns in a reasonable timeframe.

21. DMCA Copyright Policy

Plastno respects the intellectual property rights of others. If you believe that content on the Site infringes your copyright, please send a written notice to our designated agent that includes:

Your physical or electronic signature
Identification of the copyrighted work you believe has been infringed
Identification of the infringing material and its location on the Site
Your contact information (address, phone, email)
A statement that you have a good-faith belief that the use is not authorized
A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner

22. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, PLASTNO DISCLAIMS ALL WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

PLASTNO DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT.

CONTENT ON THE SITE IS FOR INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE MEDICAL, LEGAL, OR PROFESSIONAL ADVICE. ANY ACTION YOU TAKE BASED ON SITE CONTENT IS AT YOUR OWN RISK.

23. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PLASTNO, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), AND EVEN IF PLASTNO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

PLASTNO'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100 USD), OR (B) THE TOTAL AMOUNT YOU PAID TO PLASTNO IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

24. Indemnification

You agree to defend, indemnify, and hold harmless Plastno, its affiliates, and their respective officers, directors, employees, contractors, and representatives from any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Your use or misuse of the Site or products
Your violation of these Terms
Your violation of any law or third-party right, including intellectual property, privacy, or publicity rights
Any User Content you submit
Any unauthorized use of your account credentials

Plastno reserves the right to assume exclusive defense and control of any matter subject to indemnification, at your expense, in which case you will cooperate fully with our defense.

25. Arbitration Agreement and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any Plastno product, whether based in contract, tort, statute, or any other legal theory, will be resolved through binding individual arbitration, not in court. This includes disputes with Plastno's officers, directors, employees, agents, affiliates, and suppliers.

Arbitration rules. Arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, available at www.adr.org. The arbitration will be conducted in English, and either remotely or in Wilmington, Delaware, at your option. The arbitrator's decision will be binding and may be entered as a judgment in any court of competent jurisdiction.

Class action waiver. You and Plastno agree that each party may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class or representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, if eligible. Either party may also seek injunctive or equitable relief in court for matters involving intellectual property, unauthorized access, or misuse of the Site.

30-day right to opt out. You may opt out of this Arbitration Agreement by sending written notice to Plastno within 30 days of first agreeing to these Terms (or within 30 days of any material update to this Section 25). The notice must include your full name, mailing address, email address used with Plastno, and a clear statement that you wish to opt out of arbitration. Opting out of arbitration does not affect any other part of these Terms.

Survival. This Arbitration Agreement survives termination of these Terms or your account.

26. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. For any claims not subject to arbitration (including small claims actions and injunctive relief claims), you and Plastno agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware, United States.

27. Limitation on Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR PLASTNO PRODUCTS MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES. Otherwise, the cause of action is permanently barred.

28. Force Majeure

Plastno is not liable for any delay, failure, or inability to perform caused by events beyond our reasonable control, including but not limited to:

Acts of God, natural disasters, wildfires, floods, earthquakes, and severe weather
Pandemics, epidemics, and public health emergencies
War, terrorism, civil unrest, and government actions or restrictions
Labor strikes, work stoppages, and workforce disruptions
Cyberattacks, data breaches, and third-party system failures
Shipping and carrier disruptions, including strikes or service outages by postal and delivery services
Manufacturing and supply chain disruptions, including those affecting Plastno's partners in China
Raw material shortages, including for plant-based, compostable, or biodegradable inputs
Utility failures, internet outages, and telecommunications disruptions
Trade restrictions, tariffs, embargoes, and customs delays

If a force majeure event materially affects our ability to fulfill orders or honor subscriptions, we will notify affected customers and work in good faith to resolve the situation.

29. Termination

We may suspend or terminate your access to the Site or your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination:

Your license to use the Site ends immediately
You remain liable for any obligations incurred before termination
Sections 13, 14, 16, 21, 22, 23, 24, 25, 26, 27, and 31 survive termination

30. International Use

The Site is operated from the United States and is intended for customers in the United States and Canada. We do not represent that the Site or Plastno products are appropriate or available in other jurisdictions. If you access the Site from outside the US or Canada, you do so at your own initiative and are responsible for compliance with local laws.

31. Miscellaneous

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time, without notice.

Severability. If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be severed from these Terms, and the remaining provisions will remain in full force and effect.

No waiver. Our failure to enforce any provision of these Terms does not waive our right to enforce it later.

Entire agreement. These Terms, together with our Privacy Policy, Returns and Refunds Policy, and Subscription Cancellation Policy, constitute the entire agreement between you and Plastno regarding your use of the Site and supersede all prior agreements and communications.

Contact for additional agreements. If you have a separate written agreement with Plastno (for example, an affiliate, creator, or wholesale agreement), that agreement governs in the event of any conflict with these Terms, but only with respect to the subject matter it covers.
